Client NALA Holds Press Conference Print

Firm client, the Nevada Association of Latin Americans--- better known as "NALA"--- held a press conference at 10:00 am today (January 28, 2010) to alert the public to the Southern Nevada Regional Housing Authority's scheme to drive NALA out of the building it has occupied and used for its affordable childcare program since 1979.  NALA provides affordable childcare and education on a sliding scale basis to low income families of all races, religions and backgrounds.  As any parent would agree, for those of us who have the good fortune to still be employed, affordable childcare is more important now than it has ever been.

The Housing Authority voted in a meeting approximately a week and a half ago to terminate NALA's lease allegedly "for cause".  However, the Housing Authority took this action without providing NALA with advance written notice or an opportunity to cure, all in direct contravention of the lease agreement.  NALA has the right to occupy this property under the current terms until 2011.  The Housing Authority owes a covenant of quiet enjoyment and good faith and fair dealing to NALA under the lease agreement, and its actions violate these covenants.  Since the Housing Authority has made it abundantly clear that it will not follow the terms of the lease agreement, NALA is left with no choice but to file a complaint in District Court and seek an order enjoining the Housing Authority from taking further action to remove NALA from the building.  Teale Advocate is representing NALA on a pro bono basis in this matter.
